Bar Association Elections in Rajasthan: BCI challenges the Rajasthan High Court order before Supreme Court

The Bar Council of India has challenged the decision of the Division Bench of Rajasthan High Court dated 06.12.2022 before the Supreme Court whereby the Division Bench of the Rajasthan High Court had dismissed the appeal of the BCI seeking to stay the ongoing process of election in Bar Association under Rajasthan High Court.

The Special Leave Petition has been filed by the Bar Council of India through its advocate Ardhendumauli Kumar Prasad.

One advocate Sumer Singh Ola of the Rajasthan High Court filed a petition before the Bar Council of India for ensuring compliance of the guidelines issued by the Supreme Court on the principle of "One Bar One Vote." The Bar Council of India took cognizance of the matter and by its decision dated 03.10.2022 stayed the election process throughout the state of Rajasthan in all the Bar associations.

The aspirant advocates for the Bar Election of the Rajasthan High Court Bar Association filed Writ Petition before the Rajasthan High Court Jaipur Bench in SB Civil Writ Petition No. 15113 of 2022.

Rajasthan High Court stayed the order of the Bar Council of India by its order dated 11.10.2022. Bar Council of India filed a Writ Appeal before the Division Bench of the High Court being DB Civil Special Appeal (Writ) No. 1151/2022 titled Bar Council of India V. Prahlad Sharma
