The Madras High Court has ruled that denying entry to Scheduled Caste (SC) individuals into temples is a serious violation of their dignity and legal rights. The Court stated that caste and community are human-made constructs, whereas God is neutral and inclusive.
Justice N. Anand Venkatesh made the remarks while hearing a petition seeking permission for SC members to participate in the car festival at Arulmigu Puthukudi Ayyanar Temple, scheduled from July 16 to 31.
The judge held that once a temple is open to the public, no one can be denied access based on caste.
“Preventing persons from offering prayers because they belong to the Scheduled Caste community is an affront to their dignity. This can never be permitted in a country governed by the rule of law,” the Court said.
The Court also referred to the Tamil Nadu Temple Entry Authorisation Act, 1947, which guarantees all Hindus the right to enter and worship in temples, regardless of caste. The Act, the Court noted, was the outcome of historic struggles by leaders who fought against caste discrimination in places of worship.
Accordingly, the Court directed local authorities to ensure equal access to the temple and its festivities for SC members and instructed that legal action be taken against anyone obstructing their participation.
Advocates Deepika S and TM Rajangam represented the petitioners, while Government Advocates NNR Arun Natarajan and V Meganathan appeared for the State.
