The Supreme Court has granted bail to an accused, who had been in custody for around 14 months in connection with FIR No. 485 of 2024 registered at Police Station Barauni, District Tonk, Rajasthan.

A Bench comprising Justice Manoj Misra and Justice Vijay Bishnoi set aside the Rajasthan High Court’s March 25, 2026 order rejecting his regular bail plea.

The appellant’s counsel Rishi Matoliya assisted by Nikhil Kumar Singh, Kshitish Bikarmia and Raghuveer Pujari argued that there was a serious dispute regarding whether the alleged victim was a minor and that the victim, during her deposition before the trial court, had not supported the prosecution case.

Opposing the bail plea, the counsel for the State Divyank Panwar submitted that although the victim had been declared hostile, the forensic report indicated the presence of a semen stain on her undergarment. Victim was represented through advocate Achal Singh Bule who also supported the case of the accused.

The Supreme Court, however, noted that the victim had been declared hostile and that an issue also existed concerning her actual age. Without expressing any opinion on the merits of the prosecution case, the Court held that the appellant was entitled to bail at this stage.

Accordingly, the Court allowed the appeal and set aside the Rajasthan High Court order rejecting bail. Jeetram was directed to be released on bail on terms and conditions to be determined by the trial court.

The Supreme Court made it clear that its order was based on the circumstances relevant to bail and did not constitute an expression of opinion on the merits of the prosecution case.
