The Supreme Court on Tuesday deferred hearing self-styled godman and rape convict Asaram Bapu's plea for medical bail after an AIIMS medical report stated that while he does not require hospitalisation, he would need round-the-clock medical attention.

A Bench of Justices MM Sundresh and PB Varale examined the report and scheduled the matter for hearing on August 6.

"The first part of the report says hospitalisation is not required. Then it says round the clock (medical attention). We will keep it for hearing day after," the Bench observed.

The report was submitted pursuant to the Supreme Court's July 21 direction asking the Director of the All India Institute of Medical Sciences (AIIMS) to constitute a team of doctors to conduct a comprehensive medical examination of Asaram.

The medical bail application forms part of Asaram's appeal against the Rajasthan High Court's decision upholding his conviction for the rape of a minor devotee in a 2013 case.

According to the prosecution, the survivor, then a minor, was wrongfully confined inside Asaram's kutiya at his ashram in Jodhpur's Manai area in August 2013, where she was subjected to penetrative sexual assault and criminal intimidation.

Following the trial, a court convicted Asaram along with co-accused Sanchita Shilpi, a hostel warden, and Sharad Chandra, a school director. They challenged the conviction before the Rajasthan High Court.

In May this year, the High Court affirmed Asaram's conviction under various provisions of the Indian Penal Code, the Protection of Children from Sexual Offences (POCSO) Act, and the Juvenile Justice (Care and Protection of Children) Act, prompting him to approach the Supreme Court.

Seeking interim medical bail, Asaram claimed that he was suffering from "acute internal bleeding" and required immediate medical treatment while his appeal remains pending.

However, the State of Rajasthan opposed the plea. Appearing for the State, Solicitor General Tushar Mehta had earlier told the Court that Asaram had recently travelled to Kashi Vishwanath and Ayodhya after obtaining temporary medical bail.

"He got the bail on the ground that he was in vegetative state. But now he is roaming around," the Solicitor General had submitted.

On July 17, the Supreme Court had indicated that it was not inclined to grant interim medical bail without first considering the State's response and obtaining an independent assessment of Asaram's health condition.

The Court, therefore, directed AIIMS to carry out a detailed medical examination.

After evaluating the latest medical report, the Bench decided to hear the matter on August 6 before taking a call on Asaram's request for interim medical bail.
