Delhi’s Swagath Restaurant Chain Moves HC Against Telangana-Based Hotel Over Trademark Dispute

The popular North India-based restaurant chain Swagath has filed a trademark infringement suit in the Delhi High Court against a Telangana-based hotel also named Swagath, alleging unauthorized use of its registered mark.

Taking note of the claims, Justice Amit Bansal issued notice in both the infringement suit and the rectification petition on July 4. The matter is scheduled for hearing on August 27, when the court will consider Swagath’s application for interim relief.

“Let the plaint be registered as a suit... List before the Court on 27th August, 2025 for consideration of the application for interim injunction,” the Court said.

Swagath Delhi contends that it has built significant goodwill and reputation under the mark ‘SWAGATH’ across North India. In contrast, the defendant—Hotel Swagath—has been operating under the same name since 1991 and currently runs 11 outlets in Telangana. It had also previously operated a hotel under the ‘Swagath’ name in Dubai for three years.

Swagath Delhi is being represented by advocates Hemant Singh, Mamta Rani Jha, Anupriya Shyam, and Anjeeta Rani of Inttl Advocare. The Telangana-based Hotel Swagath is represented by Senior Advocates Rajshekhar Rao and Resu Mahender Reddy, along with a large legal team including Saikrishna Rajagopal, B Shravanth Shankar, Rohit Bharadwaj, Prerna Robin, Shwetha Bhaskar Dhanturi, Vikas Dhanturi, and others.
