A Delhi court has granted interim protection to Haryanvi singer and actor Sapna Choudhary in proceedings initiated under the Protection of Women from Domestic Violence Act, 2005.
Judicial Magistrate First Class (Mahila Court) Nidhi Singh at Dwarka Courts directed Choudhary's husband, Yashveer Sahu, not to contact her, visit her residence or workplace, including the venue of her upcoming film premiere, or commit any act of domestic violence until the next hearing in the matter.
Choudhary moved the court alleging that she was compelled to leave the shared household because of Sahu's conduct and is currently residing at her parental home in Najafgarh, Delhi.
In support of her plea, she submitted an affidavit detailing the alleged incidents of domestic violence, photographs purportedly showing injuries on her body, and a pen drive containing audio recordings. Through her counsel, she expressed apprehension that she could face further violence and also raised concerns that Sahu might create a disturbance during the June 10 premiere of her film Momacu.
Her counsel argued that granting temporary protection would not prejudice Sahu, whereas refusal of immediate relief could jeopardize Choudhary's safety and affect her professional commitments.
After considering the material placed before it, the court found sufficient grounds to grant interim protection.
"Respondent is restrained from contacting the petitioner in any manner or visiting her place of residence or work (temporary or permanent, including the venue of premier of the movie as stated above) and committing any act of domestic violence till the next date of hearing," the court ordered.
The court further directed the concerned Protection Officer and the local Station House Officer to ensure compliance with the order and provide assistance and protection to Choudhary whenever required.
The order notes that Choudhary's counsel informed the court that she is legally married to Sahu and that the couple has two minor children, who are currently in his custody. However, the court observed that no documents had yet been produced to prima facie establish the marriage.
Following an assurance from Choudhary's counsel that the relevant documents would be filed on the next date, the court issued summons to Sahu and listed the matter for further hearing on July 25.
