Recently, the Delhi High Court directed Meta Platforms, the parent company of Instagram, to take immediate action against fake accounts circulating her obscene photographs.
Justice Manoj Jain ordered Meta to not only take down the objectionable content but also disclose the Basic Subscriber Information (BSI), including IP addresses, of the individuals operating the fake accounts.
“Defendant No. 1 is directed to provide Basic Subscriber Information (BSI) including IP details of Defendant Nos. 2 to 6 and take action regarding the URLs mentioned in Prayer-A of the injunction application,” the Court stated.
The direction came on an application filed by the minor through her mother, seeking permanent and mandatory injunction against the defendants and compensation for the harm caused by their actions on social media.
According to the plea, the accused had obtained obscene images of the minor through deceit, with some photos allegedly being morphed. The content was then circulated via anonymized Instagram accounts, making it difficult to identify the perpetrators despite best efforts.
The Court noted that the entire episode appeared to have begun after the minor innocently accepted a connection request. “Various accounts have been created using her identity, constituting a clear and deliberate act of impersonation,” the bench observed.
Finding a prima facie case of serious harm, the Court restrained the defendants from uploading or sharing any further objectionable content — actual or morphed — involving the minor, until the next date of hearing.
The matter will now be heard on September 8.
