Four failure attempt for MBBS, candidate seeks another chance: CJI showed displeasure

After four unsuccessful attempts, candidates filed a petition to be allowed to retake the first professional university exams for the MBBS. CJI DY Chandrachud expressed his displeasure with the petitioners. A court made up of Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala heard the case. 

Chief Justice DY Chandrachud responded to the plea by quoting from the 2019 Regulations on Graduate Medical Education (Amendment):

"The regulation prohibits you. We will hear the matter on merits. We will list it."

The petitioners' attorney emphasised that the candidates' attempts were made during the COVID-19 pandemic and that, if the plea was not heard, more than 1000 students would not be able to pursue careers as doctors. 

To alter the Regulations on Graduate Medical Education, 1997, the Regulations on Graduate Medical Education (Amendment) 2019 were passed in 2019. The revised rules are as follows:

"No more than four attempts shall be allowed for a candidate to pass the first Professional examination. The total period for successful completion of first Professional course shall not exceed four (4) years. Partial attendance of examination in any subject shall be counted as an attempt."
