The Supreme Court on Monday directed the Central government to constitute a committee within two weeks to frame uniform guidelines for providing post-retirement facilities to retired High Court judges across the country.

A Bench of Chief Justice of India Surya Kant, Justice Joymalya Bagchi, and Justice V. Mohan observed that there is significant disparity in the facilities extended by different States, with some providing comprehensive support while others offering little or none.

Emphasising the need for a consistent national policy, the Bench noted that the Union government also provides financial assistance for such facilities and, therefore, should establish a mechanism to ensure uniformity.

"There can indeed be no doubt that these facilities must be ensured on a uniform basis, as there is no reason whatsoever for such amenities to vary from State to State," the Court observed.

The Court directed that the committee submit its recommendations to the Union government and place them before the Supreme Court within three months of its constitution.

During the hearing, Justice Joymalya Bagchi underscored the importance of security for retired judges, observing that providing the services of one police officer for five years was reasonable considering that High Court judges deal with sensitive matters during their tenure.

CJI Surya Kant also expressed concern over the low financial allocations for post-retirement support, referring to a provision that earmarked only ₹15,000 towards secretarial services, security, travel and other facilities.

The matter is scheduled to be taken up again after three months.
