SC directs CJ, Patna HC to investigate a police officer's complaint alleging assault inside the District Judge's chamber

On Monday, the Supreme Court of India directed Patna High Court Chief Justice Sanjay Karol to investigate a police officer's complaint that he was assaulted inside the chambers of an Additional District Judge (ADJ) in Patna. The top court's bench of Justices MR Shah and CT Ravikumar stated on Monday that if the allegations are true, the Court will not endure it. "What is happening in the High Court? We do not know what is right or wrong. But if it is true, how can we tolerate it?" the Court said.

"Let Chief Justice of Patna High Court look into the complaint of the petitioner and take a decision independently. Hon'ble High Court make consider the counter filed by the judicial officer. The Chief Justice of the High Court should bear in mind the paramount importance of judicial discipline of the institution as whole," it said.

Usha Devi, the wife of Deepak Raj, filed a complaint alleging that the petitioner, the station house officer of Ghoghardiha police station, threatened to falsely implicate Devi, Raj's husband, and other family members.

According to the petition, when the petitioner arrived at the chamber of ADJ Avinash Kumar, he began abusing him, and when the petitioner protested, he was severely assaulted at the ADJ's request.

An FIR was filed against the judge, but only after a lengthy delay on June 20, 2022. When the petitioner's FIR was challenged in the High Court, the court found that the police officers who registered it were in contempt of court. Gopal Krishna filed an appeal with the Supreme Court, challenging a Patna High Court order dated August 31 that accepted the closure report in his complaint against the District Judge.
