The Judge who gave dissenting judgment in demonetization case

A constitution bench of the Supreme Court delivered its judgment upholding the demonization of the Modi Government on the first working day of the Supreme Court in 2023 i.e. 02nd January 2023. The judgment was delivered by a majority of 4:1. While Justices S. Abdul Nazeer, BR Gavai, AS Bopanna and V. Ramasubraminain stated that there was no wrong in the process of demonization, Justice BV Nagarathana declared it illegal.

Who is Justice BV Nagarathna?

Justice Nagarathna did her LLB from Delhi University. After completing her law studies, she started her practice as an advocate before the courts in Bangalore. She used to work with Barrister Vasudev Reddy and GV Shantraju.

In the year 2008, she was elevated as an additional judge of the Karnataka High Court.

In 2009 when Justice Dinakaran was alleged of corruption and misuse of his post and office, a strike took place and the advocates locked them in a room when with one more judge when they were hearing the petition against Justice Dinakaran. 

As per the media report, she was attacked also. On that issue, she said, "We are not angry but we are sad that Bar did this to us. We are ashamed."

In the year 2010, she was made a permanent judge of the Karnataka High Court.

In 2021 she was elevated to the Supreme Court as a judge when 9 names were cleared by the Central Governmnet appointing 9 judges in one day.

She had given many big judgments but her 4 judgments are considered to be the biggest of them such as 1. Temple is not a place of business, the employees would not get gratuity, 2. She scolded the state government on the issue of migrant laborers during Covid Lockdown, 3. In 2021 on the issue of the compassionate appointment she said no child is born in the world without parents, 4. She also declared the Central Government's decision of making 85% portion of the tobacco packaging with photographic caution.

She is also the daughter of Ex-Supreme Court Judge EV Ventatrammiya. Her father also became Chief Justice of India in 1989. 

Justice Nagarathna is a resident of Pandavpura Panchayat of Mandya District of Karnataka.

She is also set to be the first-ever woman Chief Justice of India as per the present system.
