Woman Moves Delhi HC to Preserve Sperm of Husband in Coma

Today, a Woman approached the Delhi High Court seeking permission to have a child using her husband’s sperm, as he has been in a coma for more than a year.

The husband of the petitioner, has been in the ICU since March 2026 and is in a persistent vegetative state.

As per the medical team, his condition is extremely critical and he is on life support. In this situation, the woman has asked the court to allow her to preserve his sperm so she can become a mother in the future.

Counsel for the petitioner, Adv. Arjit Gaur, told the court that time is crucial.

He said the sperm needs to be collected and preserved while it is still viable. Any delay, he argued, could reduce its quality and end her chances of having a child.

To move forward, the woman has suggested that the court form a medical expert board. This board would check whether doctors can safely collect and preserve the sperm given her husband’s condition. IVF specialist Dr Shivani Sachdev explained that doctors can perform a procedure called surgical sperm retrieval, where they extract sperm from the testes using a fine needle.

They then freeze the sperm at minus 196°C, allowing it to be stored for a long time. She also clarified that being in a coma does not necessarily affect sperm quality.

However, the case involves serious legal challenges. Current laws require consent from both husband and wife before using sperm. Since the husband cannot give consent, this becomes a major issue.

The next date of hearing will be tomorrow.

The Central government’s lawyer, Ayush Gaur, said authorities are carefully examining the issue. The court’s decision could have a big impact on similar cases in the future
