‘Heavens Won’t Fall’: SC Declines Urgent Listing of Plea Against SCBA 2025 Elections

The Supreme Court on Wednesday refused to urgently list a petition challenging the 2025 elections of the Supreme Court Bar Association (SCBA), remarking, “Heavens won’t fall,” and emphasizing that the matter should be addressed by a designated Special Bench already dealing with SCBA election disputes.

The petition was filed by Senior Advocate Dr. Adish C. Aggarwala, who contested the presidential election and alleged serious electoral malpractices.

A Bench led by Justice Surya Kant noted that immediate listing was not justified and directed the petitioner to await the availability of the Special Bench comprising Justices Surya Kant and K.V. Viswanathan.

Aggarwala, who served as SCBA President in 2023–2024, claimed he received 683 votes, while Senior Advocate Vikas Singh, who was elected President for a fourth time, garnered 1,047 votes. The plea alleged irregularities such as the illegal polling of approximately 200 additional votes and a discrepancy between the number of slips issued and ballots cast. Aggarwala also accused the Election Commissioner, Senior Advocate Mahalakshmi Pavani, of campaigning for Singh and alleged that Singh continued to canvass support through emails beyond the permitted timeframe.

“There is no question of listing today. Heavens won’t fall,” Justice Kant observed while refusing interim relief. The Court stated that if the allegations are substantiated, the election result could be invalidated.

The Bench directed the petitioner to file a formal application with an affidavit and ensure service upon the opposing parties. The matter will now be heard by the Special Bench in due course. No interim order was passed.
