Allahabad HC Declines to Entertain PIL Challenging Rahul Gandhi’s Citizenship

The Allahabad High Court on Wednesday declined to entertain a public interest litigation (PIL) seeking the revocation of Congress leader Rahul Gandhi’s Indian citizenship.

This marks the third attempt by petitioner Vignesh Shishir to question Gandhi’s citizenship status, with previous pleas also being dismissed by the Court.

A Division Bench comprising Justices Attau R Masoodi and Ajai Kumar Srivastava observed that the petitioner had failed to provide any credible evidence to support his claim that Gandhi holds citizenship of another country.

"Where is that passport… Don’t fly paper at us… Where is that passport on record?" the Court remarked, expressing dissatisfaction with the lack of substantive documentation.

The Bench further noted that Shishir had already made a representation to the Central government, and emphasized that the Court could not intervene in the matter without a legally tenable basis.

During the hearing, Shishir claimed he possessed a video allegedly showing Gandhi entering Vietnam using a British passport, and further asserted that the UK government had forwarded the passport to Indian authorities. “I have 200 pages to show Gandhi is a citizen of the UK,” he told the Court.

Unconvinced by the arguments, the Court allowed the petitioner to withdraw the PIL, granting him the liberty to file a review petition challenging the earlier dismissal order dated May 5.

“Dismissed as withdrawn with liberty to file a review of the previous order (May 5),” the Court concluded.
