Allahabad HC Grants Bail to Three Accused in Sambhal Violence Case

The Allahabad High Court has granted bail to three individuals — Faizan, Shane Alam, and Mohammad Rihan — who were allegedly involved in the violence that broke out in Sambhal on November 24 last year.

Justice Dr. Gautam Chaudhary passed the order on Thursday, taking into account the submissions made by the defence and the overall circumstances of the case.

The incident occurred during a court-ordered survey of the Mughal-era Shahi Jama Masjid in the Kot Garvi area, which led to violent clashes between locals and security personnel. The unrest claimed four lives and left several others injured.

According to the prosecution, an FIR was lodged against 700-800 unidentified persons. It was alleged that the crowd pelted stones at the police, during which an individual opened fire, injuring a police personnel in the leg.

The defence argued that the applicants had been falsely implicated and that no specific role was attributed to them in the FIR. It was further submitted that the injury sustained by the police officer was not life-threatening and occurred on a non-vital body part.

The applicants also assured the court of their willingness to cooperate with the legal process, abide by any conditions imposed, and appear before the court as required. Their counsel highlighted that all three had been in custody since November 28, 2023, and had no prior criminal records.

After hearing the arguments, the court observed: “Considering the overall facts and circumstances, the nature of allegations, the gravity of the offence, and without expressing any opinion on the merits, this court finds it to be a fit case for bail.”
