Bombay HC Blocks Sale of Victorinox Goods by Former Dealer on Amazon

The Bombay High Court has directed Amazon Seller Services Pvt. Ltd. to immediately delist all Victorinox-branded products being sold by Gute Reise India Pvt. Ltd. (under the seller name ‘Gava Retail’), noting that the company is no longer authorized to sell goods of the Swiss brand.

Justice Somasekhar Sundaresan passed the interim order on July 11, in response to a plea filed by Victorinox India Pvt. Ltd., the Indian subsidiary of the renowned Swiss manufacturer of Swiss Army knives.

Victorinox approached the Court alleging that despite a binding July 9 order by an arbitral tribunal restraining Gute Reise from selling Victorinox products, the disputed listings remained active on Amazon—especially in the run-up to the e-commerce platform’s Prime Day sale on July 12.

While Gute Reise submitted that it had written to Amazon to delist the products and take necessary action regarding inventory stored at fulfillment centers, Victorinox argued that the products were still being offered for sale.

Recognizing the urgency of the matter due to the promotional sale and the potential ongoing violation of the arbitral tribunal’s order, the Court granted interim relief to Victorinox. The Court directed Amazon to delist all Victorinox products sold by Gute Reise, while allowing the latter to continue selling non-Victorinox products through its Amazon account.

The matter has been scheduled for further hearing on July 30, 2025.

Victorinox India was represented by Advocates Samudra Sarangi, Joran Diwan, and Riya Kalra, instructed by Diwan Law Associates and Law Offices of Panag & Babu.
Gute Reise was represented by Advocates Kavisha Shah and Shweta More, instructed by India Law Alliance.
