Bombay HC Grants Urgent Interim Relief to Uber Against Threat of Violent Rickshaw Union Protests

Recently, the Bombay High Court granted urgent ex parte ad interim relief to Uber, restraining rickshaw driver unions from disrupting its services amid threats of violence and property damage starting July 23.

Justice R.I. Chagla, hearing the plea, took note of Uber’s submissions that its services and drivers were being targeted by union-led agitations demanding parity with black-and-yellow taxis and a ban on bike taxis.

Uber’s counsel informed the Court that the situation had escalated from verbal agitation to physical intimidation, including threats, property damage, and incidents where drivers were chased and their cars vandalised near Mumbai airport. Despite prior police complaints and warnings, union members continued to incite disruption, including distributing pamphlets urging drivers to stop operating.

Citing similar reliefs granted in other cities such as Delhi, Bengaluru, and Hyderabad, Uber also sought police assistance to protect its drivers and customers.

The Court observed that Uber had made out a strong case for urgent relief, especially since the union’s notice specifically threatened to stop and damage all Uber vehicles from July 23 onwards.

“The plaintiffs have made out a strong case for ex parte ad interim relief. Given the previous conduct of the defendants, the planned protest would not be peaceful. Orders must be passed to prevent such illegal actions,” the Court held.

Accordingly, an ex parte ad interim injunction has been granted against all defendants, including unnamed individuals, until further orders.
