A Delhi court has granted bail to Pooja Rajput in a case involving an alleged fake Enforcement Directorate (ED) raid at a residence in New Friends Colony (NFC), observing that the investigation against her had been completed and no useful purpose would be served by keeping her in custody.
Additional Chief Judicial Magistrate Vinod Joshi of the South-East District, Saket Courts, passed the order on June 11 in State v. Pooja Rajput.
While allowing the bail plea, the Court noted that the articles recovered from Rajput's residence were allegedly linked to co-accused Prakash, who has already been arrested. It further observed that the chargesheet had been filed and that Rajput had spent a considerable period in judicial custody.
"The chargesheet has been already filed against the accused and this is the first bail application since filing of chargesheet. Hence, no fruitful purpose shall be served by keeping the accused behind bars," the Court said.
The FIR stems from an incident in February, when three men allegedly posing as ED officials entered the home of 86-year-old retired senior architect RC Sabharwal in NFC. The accused are alleged to have intimidated the family, seized their mobile phones, and directed them to place cash and jewellery on a table during the purported raid.
During the investigation, police arrested Rajput and Rekha Devi, a domestic worker employed at the complainant's residence. Rajput, who is Rekha's sister-in-law, is alleged to have been part of the conspiracy to defraud the elderly victim.
According to the prosecution, a police uniform and identity cards allegedly connected to co-accused Prakash were recovered from Rajput's house.
Seeking bail, Rajput's counsel argued that she was not the principal offender in the case and that no incriminating recovery had been made from her. It was further submitted that she had remained in custody for a substantial period and was prepared to comply with any conditions imposed by the Court.
The State opposed the plea, contending that Rajput was an active participant in the conspiracy. The prosecution also stressed the gravity of the allegations and pointed out that two accused persons are still absconding.
The Court ultimately granted Rajput bail on furnishing a personal bond of ₹25,000 along with two sureties of the like amount.
Advocate Gaurav Nautiyal appeared for Rajput, while Additional Public Prosecutor Tarun Srivastava represented the State.
