Delhi Court Sentences Tahir Hussain To 2 Years In Jail For Abetment To Rioting

A Delhi court on Friday sentenced former Aam Aadmi Party (AAP) councillor Tahir Hussain to two years in prison after convicting him of abetment to rioting in a case related to the 2020 Delhi riots. The Court also imposed a fine of ₹10,000 on him.

Additional Sessions Judge Praveen Singh of the Karkardooma Court observed that Hussain had provided his house to rioters for their use. The Court noted that although the prosecution had failed to establish his active participation in the riots, this did not reduce the gravity of his conduct.

"The hand that guides is as guilty, if not more, as the hand that acts," the Court remarked.

Hussain is already serving a life sentence in the Ankit Sharma murder case.

The Court had convicted Hussain on October 10 while acquitting the other accused in the case.

The FIR was registered at the Dayalpur police station under Sections 147, 148, 149, 427, 436 and 120B of the Indian Penal Code (IPC).

The case arose from a complaint filed by Irshad Ali, who alleged that his shop was looted and set on fire on February 24, 2020. He claimed losses of ₹17–18 lakh due to stolen goods and an additional ₹10 lakh in property damage.

Another complainant, Mohd Zahid, alleged that rioters raised slogans in support of Hussain. Two constables identified Hussain during the investigation.

Special Public Prosecutor (SPP) Madhukar Pandey appeared for the State, while advocate Rajiv Mohan represented Hussain.
