The Delhi High Court has disposed of a plea filed by a former Special Judge of the National Investigation Agency (NIA), seeking directions to the Centre and Delhi Police for the issuance of an arms license citing personal security concerns.
Justice Subramonium Prasad closed the proceedings after government counsel submitted that a decision on the Judge’s pending application would be taken within four weeks.
The petitioner, currently posted in Delhi, had applied for an arms license in November 2023. He alleged that no action had been taken on his request, reflecting a "casual" attitude by the Arms Licensing Authority.
In his plea, the Judicial Officer highlighted his tenure at sensitive postings, particularly as the Special Judge, NIA Court, Tripura—an area prone to terrorist activities. He contended that both he and his family faced potential life threats due to his past judicial assignments.
Citing Article 21 of the Constitution, the petitioner argued that forcing his family to live without any security amounted to a violation of their right to life and personal liberty. He sought the license as a measure of self-defense and to ensure unrestricted movement free from external threats.
Taking note of the Union government's assurance that a decision would be rendered within four weeks, the Court held that the petitioner’s grievance stood addressed and disposed of the writ petition accordingly.
