Delhi HC Protects Jubin Nautiyal’s Personality Rights

The Delhi High Court has issued an interim order safeguarding singer Jubin Nautiyal’s personality and publicity rights.

On February 19, Justice Tushar Rao Gedela restrained multiple AI platforms, websites, and e-commerce portals from using Nautiyal’s name, voice, singing style, image, or likeness without authorization. The Court also directed the removal or blocking of links, videos, apps, and websites violating these rights.

Nautiyal had approached the Court after certain AI tools allegedly cloned his voice, mimicked his singing style, and created digital avatars and deepfake content without consent. The complaint highlighted unauthorized face morphing, synthetic voice models, and chatbots built around his persona.

The Court observed that the damage to Nautiyal’s image and personality appeared immediate and tangible. “The plaintiff has a prima facie strong case… The balance of convenience is tilted in favour of the plaintiff. Without the interim relief, the irreparable loss may not be compensated monetarily,” it stated.

The order bars infringers from exploiting Nautiyal’s personality traits commercially or personally, across websites, social media, and the metaverse. AI-generated voice models, digital avatars, caricatures, and similar content imitating him are specifically prohibited.

During the hearing, the Court questioned the jurisdiction of the Delhi High Court, noting that Nautiyal resides in Uttarakhand and some defendants are based in Romania and the UAE.

Advocates Vivek Vidyarthi, Suvigya Vidyarthi, Sarvagya Vidyarthi, Nischay Chaudhary, Apoorva Singh, Rushali Rawat, and Samriddhi Shukla represented Nautiyal.
