The Delhi High Court has allowed a top-ranked student to get admission to AIIMS’ DM (Critical Care Medicine) course after the institute had canceled it.
The court said that the required 3 years (1,095 days) of postgraduate training can be completed across more than one institute, as AIIMS’ rules do not say it must be from a single place.
The bench headed by Justice Jasmeet Singh said AIIMS cannot make new eligibility rules at the last stage of admission. He explained that the prospectus only says 3 years of training are needed and does not require it to be from one institute.
The student had done very well in the entrance exam and was selected, but AIIMS canceled his admission because his 3 years of training were spread across more than one institute.
The student argued that the rules only ask for the total number of days, not that it must be from one place. AIIMS said training at one institute is important for academic standards.
The court disagreed, saying:
“Any eligibility rule must be clear and written. Since the prospectus does not say training must be at one institute, AIIMS cannot add this condition later.”
The court added that while it usually avoids interfering in academic decisions, it can step in when a rule is applied unfairly.
The court ordered AIIMS to process the student’s admission.
