The Delhi High Court on Friday directed social media platforms and pornographic websites to immediately remove deepfake and AI-generated pornographic content targeting a social media influencer.
Justice Purushaindra Kumar Kaurav passed an interim order, strongly condemning the material as "appalling, deplorable, defamatory" and a blatant violation of the plaintiff’s fundamental rights.
The Court permitted the influencer to notify intermediaries, including defendant numbers 28 to 31, of any newly discovered URLs carrying the offensive content. The concerned platforms were ordered to act upon such notifications promptly.
The plaintiff had approached the Court alleging that her morphed images and videos were being circulated online in a sexually explicit and defamatory manner. It was argued that the dissemination of such content infringed her fundamental rights to privacy, dignity, and reputation, and also amounted to a serious civil wrong.
Agreeing with the submissions, the Court granted an interim injunction, restraining further circulation of the offensive material.
Justice Kaurav also directed Meta (Facebook) and X Corp (Twitter) to reveal the identities and account details of the users responsible for uploading the defamatory posts.
In view of the sensitivity of the case, the Court ordered the masking of the plaintiff’s identity from judicial records. The Registry has been directed to delete her name from the memo of parties and amend the cause title accordingly.
