Delhi High Court Seeks Police Reply on PIL Alleging Illegal Bars and Underage Alcohol Service

The Delhi High Court on Wednesday (July 30) issued notice to the Delhi Police on a public interest litigation (PIL) alleging large-scale illegal operation of bars, pubs, and restaurants across the capital.

A Division Bench comprising Chief Justice DK Upadhyaya and Justice Tushar Rao Gedela was hearing a PIL filed by Mahtab Khan, which claims that many such establishments are functioning without valid licenses, violating excise regulations, and facilitating underage drinking.

According to the plea, several clubs and bars are illegally selling alcohol without obtaining the requisite permissions under the Delhi Excise Act and applicable rules, resulting in significant revenue loss to the state. The petition also alleges that many of these venues operate well past the permissible hours, often hosting parties until 7 AM.

“These places are openly serving alcohol throughout the night and promoting underage drinking, thereby pushing the city’s youth toward alcoholism. No regulatory restrictions are being followed, and profits are being made through illegal means,” the petition states.

The petitioner emphasizes that under the Delhi Excise Rules, only establishments with an L-16 licence — which permits 24-hour alcohol service — are legally allowed to operate round the clock. Crucially, this licence is restricted to establishments located within 5-star hotels or higher-category hotels.

The plea seeks:

  • Immediate action against clubs, bars, and restaurants operating without proper licences.

  • Suspension of operations for those violating the terms of the L-17 licence, which permits service only during designated hours.

  • Formation of a joint monitoring committee comprising officials from the Excise Department and Delhi Police to ensure regular checks and strict enforcement.

The Court has directed the Delhi Police to file its response and will next hear the matter on August 22.
