Gateway of India Jetty: SC Steps Back, HC to Rule

The Supreme Court on Monday refused to entertain a petition challenging the construction of a passenger jetty at the Gateway of India, directing the petitioner to approach the Bombay High Court. The apex court also requested the High Court to adjudicate the matter before the end of the monsoon, given the project’s urgency.


The plea, filed by an environmental activist group, sought a stay on the jetty project, citing concerns over potential harm to the heritage character of the Gateway precinct and possible ecological disruption. The petitioners argued that the development could set a precedent for commercial activity in sensitive historical zones.


A Bench of the Supreme Court, however, declined to intervene, stating that the High Court is the appropriate forum to hear the matter in the first instance. The court did not comment on the merits of the case and allowed the petitioner to withdraw the plea with liberty to approach the Bombay High Court.

The Bench further directed that, considering the seasonal constraints and infrastructural timelines, the High Court should aim to decide the matter before the monsoon ends.


Background

The passenger jetty project is part of a broader initiative to enhance coastal connectivity and tourism infrastructure in Mumbai. The plan has faced resistance from conservationists and citizens concerned about the environmental and cultural implications of the construction in a protected heritage zone.

With the Supreme Court’s direction, the focus now shifts to the Bombay High Court, which will evaluate the project’s legality, environmental compliance, and impact on public interest.
