If there is liquor vend near school then not necessary to extend its license every year : Allahabad HC

Allahabad High Court has said that if there is already a liquor vend near the school, then it is not necessary to extend its license every year. With this comment, the court has banned the extension of the license of the liquor shop near Seth MR Jaipuria School located in Azad Nagar in Kanpur after March 2025.

This order has been given by the division bench of Chief Justice Arun Bhansali and Justice Vikas on the PIL filed by Master Atharva, a five-year-old LKG student. The student had filed a PIL through his father and demanded the removal of the liquor vend located 20 feet away from the school.

The court has partially accepted it.

The petitioner said that a liquor vend has been given next to the school in violation of the government order. Due to this, there is trouble every day due to the hooliganism of drunkards.

The court had asked the state government, ''How are the liquor contracts being renewed every year...?''

The government said that the contract was before the school opened and cited the provisions.

The court explained that it is not necessary to renew the license after the expiration of the period. The license for the shop is valid until March 31, 2025, so it should not be extended after that. It was also said in the petition that often a gathering of drunkards starts from 6 to 7 in the morning.

There is also a residential area near the school, where hundreds of people live. Atharva's family complained several times to the officers in Kanpur and to the government, but no action was taken. It was argued that this school was opened in 2019 and the liquor contract is almost 30 years old.
