The Kerala High Court has granted regular bail to assistant film director Dhinil Babu in a sexual assault case linked to alleged “casting couch” practices in the Malayalam film industry.
A vacation bench of Justice Jobin Sebastian, observed that Babu had been in custody since December 3 and his medical examination was complete, and the investigation had moved past its crucial stages. Considering this the Court allowed his bail plea, subject to strict conditions.
At the same time, the Court made strong remarks on the allegations, observing that they prima facie pointed to a “casting couch”, where aspiring actors or actresses are allegedly asked for sexual favours in return for film roles. The judge said such practices exploit young artistes’ ambitions, violate their dignity, and must be dealt with strictly.
Babu works as an assistant director with Wayfarer Films Pvt Ltd., founded by actor Dulquer Salmaan. According to the prosecution, an aspiring actress was called to the production office on October 11 to discuss a possible role in a film starring Dulquer Salmaan. She alleged that once she reached the office, Babu wrongfully restrained and sexually molested her.
An FIR was registered against him under relevant provisions of the Bharatiya Nyaya Sanhita, and he was arrested on December 3. His earlier requests for anticipatory bail and regular bail were rejected by lower courts.
While granting bail, the High Court directed Babu to appear before the police every week for three months or until the chargesheet is filed. He has also been barred from contacting or threatening the complainant, tampering with evidence, and has been asked to surrender his passport
