Justice Manmohan, an alumnus of Modern School, Hindu College, and Campus Law Centre, began his legal career in 1987 when he enrolled as an Advocate with the Bar Council of Delhi.
He practised extensively in the Supreme Court of India and the Delhi High Court, handling a diverse range of cases in civil, criminal, constitutional, taxation, arbitration, and intellectual property matters.
In 2003, he was designated as a Senior Advocate. Over the years, he represented clients in several high-profile cases, including the Dabhol Power Company dispute, the Nizam’s Jewellery Trust matter, and the Claridges Hotel dispute. He also appeared on behalf of General Electric’s John F. Welch Technology Centre and regularly participated in national and international legal seminars and conferences.
Justice Manmohan was elevated to the Bench as an Additional Judge of the Delhi High Court in 2008 and confirmed as a Permanent Judge in 2009. Throughout his tenure, he delivered several landmark judgments. Notable among them are:
Mohd. Ahmed (Minor) v. Union of India (2014): Mandated the government to ensure access to life-saving treatment for economically weaker sections, including for rare diseases like enzyme replacement therapy.
Justice for All v. Govt. of NCT of Delhi (2020): Upheld the right of every child to access digital education during the COVID-19 pandemic.
Court on its Own Motion v. Govt. of NCT of Delhi (2009): Directed creation of a uniform protocol for rescue and rehabilitation of trafficked children.
Shalu Nigam v. Regional Passport Officer (2016): Allowed children to use their mother’s surname in official documents.
His contribution to intellectual property and international law has also been significant. His rulings in:
Nokia Technologies OY v. Oppo (2023) on Standard Essential Patents,
UTV Software v. 1337x.to (2019) establishing dynamic injunctions against piracy websites,
Koninklijke Philips N.V. v. Amazestore (2019) on calculating damages in trademark infringement, and
Union of India v. Vodafone (2018) interpreting Bilateral Investment Promotion and Protection Agreements,
have become key references in the legal field.
Justice Manmohan was appointed Acting Chief Justice of the Delhi High Court on November 9, 2023, and subsequently took charge as the Chief Justice on September 29, 2024.
He was elevated to the Supreme Court of India on December 5, 2024.
