Lok Sabha member Amritpal Singh has filed a petition before the Punjab & Haryana High Court questioning the validity of his third consecutive preventive detention order issued under the National Security Act (NSA).
Earlier, on November 10, the Supreme Court declined to examine his writ petition concerning the latest NSA detention but granted him liberty to move the High Court and requested that the matter be decided preferably within six weeks.
Singh, who represents the Khadoor Sahib constituency in Punjab, stated that he has remained in preventive custody since April 2023 on the basis of repeated detention orders, even though there is no substantive or credible evidence linking him to activities prejudicial to national security or public order.
He contended that the present order is arbitrary, illegal, issued without proper authority, and in breach of constitutional protections guaranteed under Articles 21 and 22. He also argued that the authorities failed to provide him with the relevant documents or materials relied upon for passing the detention order, making the action opaque and unsustainable.
The petition further asserts that mere reference to pending FIRs, ongoing investigations, or listing an individual as an accused cannot justify preventive detention unless the State can clearly establish a real and immediate threat to public order.
The plea emphasises that preventive detention laws cannot be invoked on speculative, unverified, or vague assumptions.
