The Supreme Court of India has laid down a comprehensive framework to address delays in the filing of legal aid appeals, prescribing mandatory timelines for all authorities involved in the process.

Approving a Standard Operating Procedure (SOP), the Court sought to streamline the mechanism through which convicts availing free legal aid challenge adverse decisions. It emphasised that timely access to legal assistance is an integral facet of the constitutional guarantee of access to justice.

In order to prioritise urgency, the Court has classified cases based on their gravity. Matters involving the death penalty or long-term incarceration are required to be processed within approximately 15 days, while other cases are subject to comparatively relaxed timelines.

The SOP delineates specific timelines for each stage of the process, including the supply of judgments, obtaining instructions from prisoners, collection of requisite documents, translation of records, and the eventual filing of appeals. These timelines are binding on all stakeholders, including High Courts, legal services authorities, prison officials, and translators.

The Court also took note of systemic delays arising from inadequate translation of records and directed High Courts to establish dedicated translation units with defined standards of qualification and accountability.

Further, the Court underscored the need for technological integration by directing the development of a centralised digital platform to facilitate case tracking, generate deadline alerts, and ensure seamless coordination among authorities.

To ensure adherence, the Court has mandated the constitution of monitoring committees at both the Supreme Court and High Court levels, which will periodically review implementation and identify bottlenecks.

The Court ultimately clarified that the prescribed timelines are binding in nature and are intended to eliminate procedural delays, particularly in cases impacting personal liberty.
