Patanjali Approaches HC Over Encroachments on Its Land Near Navi Mumbai

Baba Ramdev-led Patanjali Foods Private Limited has filed a petition before the Bombay High Court seeking urgent directions to the Maharashtra government and its authorities to remove alleged illegal encroachments on its land parcels in Khalapur, Raigad district, near Navi Mumbai.

Filed through Advocate Apoorv Srivastava, the plea accuses state authorities of inaction in the face of unauthorised occupations and constructions on land owned by the company.

According to the petition, three individuals — Sunil Malsure, Mayur Devghare, and Sudesh Khandagale — have allegedly encroached upon the land and set up unauthorized establishments including a local politician’s office, a hotel, and a tyre shop, respectively.

“These individuals are trespassers who have blatantly violated property laws,” the petition states. It further alleges that the hotel constructed by Devghare poses a significant safety hazard to workers and others associated with Patanjali’s nearby factory. Khandagale’s tyre puncture shop is also said to interfere with factory operations and safety protocols.

The company described the encroachments as a “flagrant violation of property and safety norms,” and argued that the unauthorized structures endanger not only the property rights of the company but also the safety of employees, factory visitors, and even the encroachers themselves.

Patanjali claims it has repeatedly approached concerned officials — including the Deputy Collector, Tehsildar, Chief Engineer, and Deputy Chief Engineer — but to no avail. The plea asserts that despite multiple complaints and warnings about the potential dangers, the authorities have failed to act.

“By not taking appropriate steps under the relevant legal provisions, the authorities are effectively enabling illegal encroachers to continue unlawful occupation and usage of the petitioner’s property,” the petition adds.

The matter was initially listed for hearing on Thursday before a Division Bench of Justices Revati Mohite-Dere and Dr Neela Gokhale. However, it has now been transferred to the bench of Justices Girish Kulkarni and Arif Doctor, which is currently assigned to hear such matters.
