The prosecution in the 2024 Porsche crash case told a Pune court on Wednesday that the accused are using "frivolous" applications to delay the legal process.
The case involves a 17-year-old who allegedly drove a Porsche while drunk and crashed into a two-wheeler in Pune’s Kalyani Nagar on May 19, 2024, killing two IT professionals — Anish Awadhiya and Ashwini Costa.
Currently, the court is hearing arguments on framing charges against 10 accused in a related case of blood sample swapping. The prosecution claims that after the crash, the teen's blood samples were illegally replaced with those of his mother at Sassoon General Hospital to hide alcohol consumption.
Special Public Prosecutor Shishir Hiray said all 10 accused, including the teen’s father, hospital doctors, and middlemen, were involved in the conspiracy. Nine of them are in jail.
Hiray told the court that the defence is delaying proceedings by filing unnecessary applications, such as requests for a copy of the chargesheet—even though, according to the prosecution, the full chargesheet has already been provided.
On the other hand, the defence argued that only partial documents were shared. Sudhir Shah, lawyer for accused doctor Ajay Taware, argued that sections of the Indian Penal Code related to forgery (Sections 467 and 464) do not apply to his client. Shah said Taware was not at the hospital when the alleged blood sample swap took place and cannot be charged for forgery if he didn’t directly commit it.
Others in jail include the juvenile’s father, doctors from Sassoon Hospital — Ajay Taware and Shrihari Halnor — a hospital staffer, two middlemen, and three others. The teen is being dealt with separately by the Juvenile Justice Board.
