The Punjab and Haryana High Court has granted bail to a man accused of spying for Pakistan during Operation Sindoor.
The bench headed by Justice Vinod S Bhardwaj said the State could not show any proof that the accused had actually shared Army-related information with Pakistan. The Court also noted that sanction under the Official Secrets Act is still pending, so the trial has not even started yet.
The case is against Davender Singh, who was accused of spying and passing sensitive information about Army movements.
The issue began in May 2025, when police first noticed him for posting photos with weapons on Facebook. They registered a case under the Arms Act and seized his phone. After he got bail in that case, police filed another FIR on May 15, 2025, claiming he had links with people in Pakistan.
According to the police, Davender had visited Pakistan in November 2024 for a religious trip to Kartarpur Sahib and Nankana Sahib. During that visit, he allegedly came in contact with some people suspected of being linked to espionage.
The police said that after returning to India, he stayed in touch with one such person, “Shah Ji”, through WhatsApp and Snapchat. They also claimed he recorded Army movements and collected sensitive information. A video of Army vehicles was found on his phone, and they alleged he deleted some data out of fear.
However, Davender’s lawyer denied these claims. He said the trip to Pakistan was only for religious purposes and that pilgrims remain under strict supervision. He also pointed out that the alleged calls happened before Operation Sindoor began, and there was no communication after the operation started.
During the hearing, the Court repeatedly asked the State if there was any proof that Davender actually shared any Army-related information with Pakistan. The State could not give a clear answer.
The Court also noted that apart from the Arms Act case, Davender had no criminal record. Considering all this, and the delay in getting sanction under the Official Secrets Act, the Court granted him bail.
