Rajasthan HC Quashes JDA Order Removing Assistant Advocates

The Rajasthan High Court has cancelled the Jaipur Development Authority (JDA)’s decision to remove several lawyers who were working as Assistant Advocates.

The bench of Justice Ganesh Ram Meena made it clear that lawyers cannot be treated like ordinary employees who can be removed without any proper process. The Court said such decisions must follow rules and fairness.

The Court ordered JDA to allow these lawyers to continue in their roles. It also directed the authority to create a proper policy covering how Assistant Advocates are appointed, how long they serve, and how they can be removed.

The Court further said that these lawyers should continue working as long as their performance remains satisfactory or until new rules are framed.

While hearing the case, the Court noted that the lawyers were removed even though there were no complaints about their work. In fact, their performance had been recorded as satisfactory. The Court found it unfair that they were removed without any valid reason.

The judges also observed that although the government has the power to choose its lawyers, such decisions cannot be random or arbitrary.

In addition, the Court asked the State to ensure better representation of women lawyers and those from Scheduled Castes, Scheduled Tribes, backward classes, and weaker sections.

In the end, the Court quashed the removal orders and allowed the lawyers to continue as Assistant Advocates.
