SC to Hear Woman Lawyer’s Plea Alleging Sexual Assault by Gurugram Police Officers

The Supreme Court of India is set to hear a crucial petition on June 5 filed by a woman lawyer who has accused Gurugram police personnel of sexual assault, physical harassment, and illegal detention.

The petitioner, a practicing advocate and office-bearer of the Tis Hazari Bar Association (Delhi), has alleged that she was assaulted inside Sector 50 police station on May 21, while she was present in connection with a matrimonial case. She claims that male police officials sexually assaulted her, while female officers subjected her to physical violence. She was allegedly detained without proper documentation and denied the right to contact her family or colleagues.

According to the plea, she was also coerced into consuming an unknown substance, which she refused. The petition highlights that no arrest memo was issued and accuses the police of violating her fundamental rights.

A bench of Justices Prashant Kumar Mishra and Augustine George Masih, after a brief hearing, asked the petitioner’s counsel to obtain a copy of the FIR registered against her by the Gurugram Police. The bench observed that the appropriate course would be to apply for the FIR through the concerned Magistrate. The matter is now listed for hearing tomorrow (June 6).

Counter-FIR and Demand for CBI Probe

In a twist, a counter-FIR has been registered against the woman lawyer under various sections of the Bharatiya Nyaya Sanhita (BNS). Alleging a conflict of interest and lack of impartiality, the petitioner has asked for transfer of the investigation to either the CBI or the Delhi Police, along with disciplinary action against the concerned officers and protection from further harassment.

The case has drawn the attention of legal circles and women’s rights activists, many of whom are demanding an independent inquiry and institutional safeguards for lawyers facing abuse from law enforcement agencies.
