The Supreme Court on Monday (October 27) granted bail to three accused persons Danish, Faizan, and Nazir in connection with the violence that erupted in Sambhal on November 24, 2024, during a court-ordered survey of the Jama Masjid to ascertain whether a temple once existed at the site.
A Bench comprising Justice P.S. Narasimha and Justice R. Mahadevan passed the order while hearing special leave petitions filed by the three accused. The petitioners were represented by Advocate Sulaiman Mohd Khan.
Faizan and Danish had challenged the Allahabad High Court’s order dated May 19, 2025, which had dismissed their bail pleas in connection with FIR No. 337/2024. The FIR arose out of the alleged violent incident that took place when the district administration and police were carrying out the survey of the Jama Masjid pursuant to the November 19, 2024 order of the Civil Judge (Senior Division), Chandausi, District Sambhal, in Civil Suit No. 182/2024.
As per the FIR, a large group of protestors gathered to oppose the survey, leading to stone pelting and firing. The violence reportedly resulted in injuries to police personnel and damage to government vehicles.
The FIR invoked multiple offences under Sections 191(2), 191(3), 190, 109(1), 125(1), 125(2), 221, 132, 121(1), 121(2), 324(4), 323(B), and 326(F) of the Bharatiya Nyaya Sanhita (BNS), 2023, along with Section 7 of the Criminal Law Amendment Act, 1932, Sections 3 and 4 of the Prevention of Damage to Public Property Act, 1984, and Sections 3, 25, and 27 of the Arms Act, 1959.
Nazir, the third accused, challenged two separate orders of the Allahabad High Court dated May 28, 2025, in connection with FIR Nos. 304/2024 and 305/2024. The FIRs registered against him carried similar charges under the BNS, Criminal Law Amendment Act, Prevention of Damage to Public Property Act, and Arms Act. Both FIRs were registered at the instance of a Sub-Inspector of the Uttar Pradesh Police.
After hearing the parties, the Supreme Court granted bail to all three accused, setting aside the High Court’s earlier refusal to do so.
