A Special Executive Magistrate in Delhi has ordered the release of Cockroach Janta Party (CJP) spokespersons Saurav Das and Ashutosh Ranka, who had been in judicial custody since October 14 for allegedly entering Jantar Mantar and waving national flags in protest against the denotification of the site as a designated protest venue.
The two were released on Wednesday after the court accepted their personal bonds and surety bonds. Reacting to the development, Das said, “Truth has triumphed.”
Das and Ranka had allegedly scaled the locked gates of Jantar Mantar on October 13 and waved national flags to protest the site's denotification. The prosecution argued that their actions violated a peace bond they had signed after being detained on October 10.
The two CJP spokespersons were initially remanded to judicial custody for five days on October 14, which was subsequently extended by two days on Monday.
During Wednesday's proceedings, the Delhi Police sought a further three days of judicial custody. After hearing both sides, the magistrate reserved the order and subsequently directed their release after accepting their bonds.
The court, however, clarified that the inquiry would continue. It directed Das and Ranka to furnish personal bonds and surety bonds of ₹50,000 each. The matter is scheduled for further hearing on Friday.
In their undertaking before the court, the two leaders promised not to breach the peace and reaffirmed their commitment to law and order, public tranquillity and the Constitution. They also undertook not to call for protests at Jantar Mantar until its denotification was dealt with in accordance with law.
The release order came after the CJP approached the Delhi High Court challenging the extension of the leaders' custody, alleging that the proceedings were being deliberately delayed to prevent their release.
During the High Court hearing earlier on Wednesday, the Bench referred to the alleged breach of the peace bond and cautioned that breaking barricades could encourage others to follow suit and potentially lead to violence. The Court also referred to instances in other countries where student protests had escalated into arson and destruction of public property.
The CJP, founded by Abhijeet Dipke, has organised protests over various issues, including paper leaks and alleged irregularities in the Special Intensive Revision (SIR) of electoral rolls. The party has also demanded the resignation of Chief Election Commissioner Gyanesh Kumar.
